Terms of Service

These terms govern your use of CusenReach, a customer-communication and CRM platform operated by Cusenware Tech Sciences ("CusenReach", "we", "us"). By creating a workspace or using the service you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

1. The service

CusenReach lets a business connect its own messaging channels — WhatsApp Business, Instagram, Facebook Messenger, Telegram, email and others — and manage the resulting conversations, contacts and sales pipeline from one place. Features vary by subscription plan.

2. Your account

• You must provide accurate registration details and keep them current.
• You are responsible for activity under your account and for your users' credentials.
• You must tell us promptly at security@cusenreach.com if you suspect unauthorised access.
• You must be old enough to enter a contract in your jurisdiction.

3. Connected channels

You may only connect accounts, Pages and phone numbers that you own or are authorised to administer. When you connect a Meta channel you are also bound by Meta's own terms, and by the WhatsApp Business Messaging Policy where applicable. We act on your instructions in respect of those channels; you remain responsible for the messages your workspace sends.

4. Acceptable use

You must not use CusenReach to:

• Send unsolicited bulk messages, or message people who have not opted in where opt-in is required
• Send unlawful, deceptive, harassing, hateful or infringing content
• Impersonate another person or business
• Attempt to breach, overload, reverse-engineer or circumvent the platform or its limits
• Resell or provide the service to a third party except as expressly permitted in writing
• Upload malware, or use the service to gain unauthorised access to any system

We may suspend a workspace that materially breaches this section, and will tell you why.

5. Your data

You keep ownership of the content in your workspace — your contacts, conversations, templates and files. You grant us the limited licence needed to host, process and transmit that content in order to provide the service. Our handling of personal data is described in the Privacy Policy, and deletion is described in the Data Deletion Instructions.

6. Fees and consumption

Subscription fees and consumption-based charges (for example message and AI usage) are shown in your plan and billing screens. Fees are payable in advance unless agreed otherwise, and are exclusive of taxes unless stated. Consumption is metered in your workspace and visible to you before and after use. We will give notice before changing prices for an existing subscription.

7. Third-party services

The service integrates with third parties, including Meta. We are not responsible for their availability, their policies, or changes they make to their APIs. A channel may stop working if the provider revokes access or changes its terms.

8. Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, and will give reasonable notice for planned work that causes downtime.

9. Warranties and liability

The service is provided "as is". To the maximum extent permitted by law we exclude implied warranties, and our aggregate liability arising out of or relating to the service is limited to the fees you paid in the 12 months before the event giving rise to the claim. We are not liable for indirect or consequential loss, or for lost profits, revenue or data. Nothing here limits liability that cannot be limited by law.

10. Suspension and termination

You may cancel at any time from your billing settings. We may suspend or terminate for material breach, non-payment, or where required by law. On termination you may export your data for 30 days, after which it is deleted in line with the Privacy Policy.

11. Changes to these terms

We may update these terms. For material changes we will notify account administrators before they take effect. Continuing to use the service after that constitutes acceptance.

12. Governing law

These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence.
