By accessing or using CusenReach, you agree to these Terms.
1. Platform Description
CusenReach is a SaaS platform enabling businesses to communicate with customers using the Meta WhatsApp Cloud API, CRM, automation, and analytics tools.
The platform operates on:
- Subscription plans
- Prepaid message credits
- Meta pass-through charges
2. User Obligations
Users must:
- Comply with all applicable laws
- Follow WhatsApp Business Policy and Meta Terms
- Obtain explicit opt-in consent before messaging
- Maintain records of consent
- Use only approved templates
- Not send unsolicited or promotional spam
3. Prohibited Use
Users shall not:
- Send spam or misleading messages
- Impersonate any entity
- Promote illegal products
- Use scraped numbers
- Violate Meta policies
- Upload malicious content
4. Billing & Credits
- Messages require prepaid credits
- Meta conversation charges are pass-through
- No refunds for consumed credits
- Pricing may change with Meta rates
- Disputes must be raised within 7 days
5. Service Levels
- Platform provided on best-effort basis
- Delivery depends on Meta services
- No guarantee of message delivery or timing
- Maintenance windows may occur
6. Suspension & Termination
We may suspend accounts for:
- Policy violations
- Spam complaints
- Non-payment
- Legal requirements
Termination may occur without refund for violations.
7. Data Responsibility
- Users own their data
- Platform processes data on behalf of users
- Data shared with Meta Platforms Inc for delivery
- Users are controllers of recipient data
8. Intellectual Property
- CusenReach software remains property of Cusenware
- Users may not reverse engineer or resell
9. Limitation of Liability
Cusenware Tech Sciences is not liable for:
- indirect losses
- business interruption
- Meta service disruptions
- user policy violations
Total liability limited to last 1 month fees.
10. Indemnity
User agrees to indemnify Cusenware against:
- spam claims
- consent violations
- illegal content
- Meta penalties
11. Changes
Terms may be updated with notice on website.
12. Governing Law
Jurisdiction: Surat, Gujarat, India.
